Advocacy / news

Advocacy team identifies and responds to issues of concern to the business community that can be resolved by a legislative & regulatory change. Based on members input, we comment and propose new laws, amendments or position papers and advocate them with the Government, Ministries and Parliament. Among our major past successes are the new Insolvency Act, the Commercial Registry reform, capping the Social Security Contributions and Amendment to Act on Public Procurement. According to AmCham Policy Priorities for 2014 we are currently working on Economic Development (Tax Policy, Healthcare, City Strategies, R&D etc.) and Good Governance (Political Party Finance, Public Administration reform etc.) Projects. AmCham initiated the Council for Czech Competitveness, which has been established as a forum for debating and advocating improvements in economic policy. Every Monday Policy Pipeline is issued, where current policy&economic news in the Czech Republic, EU an US&Globe are listed.

SAVE THE DATE: April 9, 2014 - 9th Regional Tax Conference in Warsaw

9th Regional Tax Conference of American Chambers of Commerce from Central and Eastern Europe will be held on April 9, in Warsaw, Poland. This year’s conference "Ten years in the European Union: Impact on taxation in Central and Eastern Europe” will focus on the impact the EU membership had and is going to have on tax systems of the countries in the region.  As in prior years, the objective of the Conference is the exchange of best practices and ideas in the area of taxation between the representatives of tax administrations and business from the CEE countries. Final agenda and speakers will be announced soon.

AmCham held Civil Code Series to prepare members for new Civil Code, which came into force on January 1, 2014

Throughout years 2012 and 2013 AmCham organized Civil Code Series. The aim of these events was to inform and discuss about main changes in the law. With the author of the new Civil Code and new Corporations Act Bohumil Havel and other panelists AmCham members could attend workshops&presentations, which covered list of topics. AmCham published New Civil Code Brief, publication in Czech and English containing articles prepared by its members about all important areas of New Civil Code.

On December 5, AmCham members met in Brno to discuss current and future development of their business. On December 6, AmCham members met 1. Comments Request by December 20: Data Protection pictures/graphics

Czech Industry Coalition for Data Protection (AmCham+ICT Unie) is planning to draw up pictures/graphics on importance of data protection of individuals and companies. These documents will serve as a briefing paper for members and the public. CICDP would like to raise awareness of protection of personal data of individuals and companies with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation). AmCham 2013-2014 Policy Priorities

The Czech Republic has come to the transition point from a successful economic strategy at a time when other, larger countries to the east are successfully undertaking similar approaches, and when the major economic powers of the European Union are being forced by increased competition to redefine their own direction. Rusnok´s Government is preparing the Public Administration Reform Act

This key law is supposed to raise quality and effectiveness of public administration of the Czech Republic, making the system more stable with civil servants being less politically dependent. Czech politicians do not have time to waste, as the adoption of the Public Administration Reform is a precondition for the Czech Republic to be able to receive essential funds from the European Union. If the European Commission does not receive a plan of further steps together with the draft of the legislative changes by the turn of the year, those funds might not be allocated. This complex Act is of crucial importance due to the fact that its implications will be far reaching, affecting many subjects of our society. Its core essence can be compared to the legal preparation in the run-up to its EU and NATO entry.

Zeman assured Sobotka, that he will be charged with forming the government

Chairman of the Social Democrats Bohuslav Sobotka has been invited to Lány next Thursday. It is practically certain that President Miloš Zeman will charge him to negotiate the formation of a Cabinet. Moreover, the President met with the leader of the Communist Party Vojtech Filip who debated the attitude of his Party to the legal measures adopted in the Senate. Social Democrats want to form a coalition with ANO and KDU-ČSL. If the discussion goes well, the government can be formed by the end of this year, Sobotka mentioned. Charging with negotiation is not in virtue of the Constitution, it is rather a convention – which implies that Sobotka cannot quite yet be certain to be appointed as a Prime Minister.

Best Cooperation of the Year - winners

The grand-prize winner is Czech company TESCAN and the Faculty of Mechanical Engineering, Brno University of Technology with the Holographic microscope camera using 3D technology. Second place received První brněnská strojírna Velká Bíteš and Brno University of technology for project Flying Laboratory for Turboprop engine TP 100. Doosan Škoda Power a University of West Bohemia were awarded third place for Diagnostics of conditions of steam turbine. ICT Aliance special award goes to Phonexia and Brno University of Technology. Minutes from Labor Code&Social Affairs Committee on September 25

AmCham Labor Code&Social Affairs Committee met on September 25 to discuss current news in legislation, past&upcoming plans and activities. The special guest of the comittee was Jitka Hlaváčková from Confederation of Industry. Senate rejected changes in the system of taxation

The Senate rejected the Bill on Taxation Changes at its last session on 12 September. The Bill was proposed by the former governmental coalition with relation to the promulgated New Civil Code. The Bill aimed at unifying terminology of the New Civil Code as well as at some substantive changes of the system of taxation. The Bill broadened tax exemption on income tax (the income tax should not be collected in the case of dividends; that was heavily criticized by the President Miloš Zeman as well as by the Social Democratic Party). Foreigners to travel on business trips without any further authorization by the Labor Office

The Supreme Administrative Court concluded that the Employment Act from 2009 does not regulate temporary business travel or other temporary deployment of employees outside the place of work specified in the work permit. It is therefore not necessary to apply for a new work permit. The Court conducted a thorough interpretation of the law. The Ministry of Labour and Social Affairs  was consistent interpretation of the Employment Act until the end of 2011. MPSV changed the interpretation from 2012 completely, so the foreigners may not go on business trips outside the place of their work. According to the decision of the Supreme Administrative Court can travel on business trips without any further authorization from the Labour Office. Read the adjudication here

Best Cooperation of the Year - submit your project by September 6

American Chamber of Commerce in the Czech Republic and the Association for Foreign Investment, in cooperation with the Technology Agency of the Czech Republic announced the third annual Best Cooperation of the Year awards and the TAČR Prize. The project is being implemented under the auspices of the Ministry of Education, Youth and Sport and the Ministry of Industry and Trade.

Projects (and parts thereof) and transfers (e.g. sales of licenses) that were implemented or completed in the period from 1 January 2012 to 1 June 2013 can be entered in the competition. Eligible projects must involve research, development and innovation realised through cooperation between a research organisation and a legal entity based in the Czech Republic or the transfer of the results of research and development from the research sphere to the application sphere.

The deadline for registering projects and transfers in the competition is 6 September 2013. The grand-prize winner will receive a financial award in the amount of CZK 100,000. Ministry of Finance: Draft Act on public insurance and management of income tax of individuals

The draft Act contains a reflection of substantive and technical changes adopted by the Act No. 458/2011 Coll., amending laws related to the establishment of a single collection point and other changes in tax and insurance law. Strategic Plan of the Czech Republic in the EU - policy for competitive Europe

The Govermnet approved the Strategy Strategic Plan of the Czech Republic in the EU - policy for competitive Europe. The Government definitely agrees with the fiscal responsibility as promoted by the EU, however, it rejects debts sharing. The Government emphasizes the common market and promotes any activities for its further extension, deepening, and finalization.
